Terms of Service

By creating an account or using Pulse, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our services.

To use Pulse, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must be at least 18 years old to create a trainer account, or 13 years old to create an athlete account with parental consent.

You agree to use Pulse only for lawful purposes and in accordance with these terms. You agree not to:

• Use the service for any illegal or unauthorized purpose
• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Transmit any harmful, offensive, or inappropriate content
• Attempt to gain unauthorized access to our systems or other users' accounts

Pulse's marketplace supports the sale of digital products and services only (such as training routines, nutrition plans, ebooks, videos and similar digital content). Trainers may not list, sell, advertise, or use the platform — including product listings, public profiles, or messaging — to arrange the sale, shipping, or delivery of physical goods. Any transaction involving physical goods arranged outside the platform is strictly between the trainer and the buyer: Pulse does not process, ship, guarantee, or assume any responsibility for such transactions. Listings that violate this policy may be removed, the trainer's account may be suspended, and pending payouts may be withheld while a violation is investigated.

You retain ownership of any content you create or upload to Pulse, including workout routines, client information, and progress data. By using our service, you grant Pulse a non-exclusive, worldwide license to use, store, and process your content solely for the purpose of providing and improving our services.

Pulse and its original content, features, and functionality are owned by Pulse and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our service without our express written permission.

Pulse integrates with third-party services whose respective terms and privacy policies govern your use of them. These include Google Sign-In for authentication and Stripe (through Stripe, Inc.) for card payment processing. As a Pulse trainer, you may generate payment links for your clients via Stripe Checkout; by generating a link you accept Stripe's Services Agreement and authorize Stripe and Pulse to process the corresponding charge. On each successful payment, Pulse deducts a platform commission (3% on the Free plan, 1.5% on paid plans) plus a payment processing fee (currently estimated at 2.9% + $0.30) covering the cost of payment processing through Stripe; the resulting net amount is credited to your available balance within Pulse. Trainers who verify a Stripe Connect (Express) account may receive coaching payouts automatically; trainers who do not verify Connect will receive their available balance through the payout method they configure in Settings. We are not responsible for the content or practices of any third-party services.

Trainers can receive payments from their clients through Pulse in three forms: coaching payments (via payment links or billing cycles), one-time sales of marketplace products, and recurring marketplace subscriptions. On each successful payment, Pulse deducts (a) a platform commission — currently 3% for trainers on the Free plan and 1.5% for trainers on a paid plan, with a minimum commission of $0.99 per transaction — and (b) an estimated payment processing fee of 2.9% + $0.30 per transaction, covering payment processing costs through Stripe (for recurring marketplace subscriptions, the processing fee is applied as a percentage only). The remaining net amount belongs to the trainer. Clients and buyers always pay exactly the price set by the trainer; commissions and fees are deducted from the trainer's share. Coaching payments are subject to a minimum charge of $5.00 and are processed in US dollars (USD). Pulse may modify commission rates and processing-fee estimates prospectively, with at least 30 days' notice by email or in-app notification; changes apply to payments processed after the effective date, including subsequent renewals of existing subscriptions.

Coaching payments are credited to your available balance as soon as the payment succeeds. Marketplace sales are first credited to a pending balance and become available after a holding period — currently 7 days for digital products and 14 days for physical products — which we use for fraud and refund protection. Trainers who complete Stripe Connect (Express) verification receive their share automatically through Stripe; by completing Connect onboarding you also accept the Stripe Connected Account Agreement. Trainers who have not verified a Connect account receive their available balance through the payout method configured in Settings, and payout requests may be subject to review before being processed.

Refunds may be issued in full or in part. When a payment is refunded, the corresponding trainer share and platform amounts are reversed proportionally from the trainer's balance or, for Stripe Connect accounts, from the associated Stripe transfer. If a client initiates a chargeback or payment dispute, the disputed amount is deducted from the trainer's balance while the dispute is being resolved, and the trainer bears the cost of lost disputes on their sales. Pulse may withhold or offset future payouts to recover refunded or disputed amounts that have already been paid out.

Trainers are solely responsible for determining, collecting, reporting and remitting any taxes that apply to the amounts they receive through Pulse. Pulse's commission and fees are exclusive of any such taxes. Pulse may provide transaction records to help with your accounting, but it does not provide tax advice; please consult a qualified tax professional regarding your obligations.

Pulse is a fitness management tool and does not provide medical advice. The workout routines and fitness information provided through our service are for general informational purposes only. Always consult with a qualified healthcare professional before starting any new exercise program. Pulse is not liable for any injuries or health issues that may result from following workout routines created or managed through our platform.

To the maximum extent permitted by law, Pulse shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or related to your use of our service.

You agree to indemnify and hold harmless Pulse and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising out of your use of the service, your violation of these terms, or your violation of any rights of another party.

We may terminate or suspend your account and access to our services at any time, without prior notice, for any reason, including breach of these terms. Upon termination, your right to use Pulse will immediately cease. You may also delete your account at any time through the app settings or by contacting our support team.

These terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these terms or your use of Pulse shall be resolved through binding arbitration.

We reserve the right to modify these terms at any time. We will notify you of any material changes by posting the new terms on our platform and updating the 'Last Updated' date. Your continued use of Pulse after such changes constitutes your acceptance of the new terms.
